Overview:
The Foreign Investment in Real Property Tax Act (“FIRPTA”) was passed by Congress in 1980, and is codified in Section 1445 of the Internal Revenue Code (26 U.S.C. § 1445). This was at a time when foreign investment in U.S. real estate was surging to an all-time high. Congress wanted to ensure that foreign investors in U.S. real estate, who might not otherwise be part of U.S. tax system, paid a tax on their sales profits of these real estate holdings – just like American citizens would. This webinar explores the implications of this act in regard to closing real estate transactions.
